One of my favorite "rules," oft expressed in the old systems (and their modern simulacrums) is, "Character creation rules are for the players, and the GM/CK/DM is not beholden to them for his or her NPCs."

I live by this in my games.

The problem with this thinking is that it's "scientific" and not "fantastic." Not really. See the example of the lit torch. Fits into the rules nicely. I have been setting the CL with the level of assassin/alchemist who made it. So a 1st level assassin could make type IV poison, give the gold and/or the materials, but it would not be as effective and thus a lower 1st level CL. Is that correct? That definitely sounds like the right way to handle it. Traps, spells, etc. are all based off the creator's / caster's level / HD, so this makes perfect sense.
